Terms of Service

1. Acceptance
By using PeekaScan (the "Service") — including the browser extension, the site at https://peekascan.com, and the worker API — you agree to these Terms. If you don't agree, don't use the Service.
2. What the Service does
PeekaScan identifies trading cards from images using AI vision and looks up publicly available market prices and sales history. Prices come from third-party aggregators and are estimates — not professional appraisals. The Service currently supports Pokémon trading cards; other games may be added over time.
3. Accounts
You may use the Service anonymously up to the free daily scan cap. To exceed it you create an account using a valid email + password, or Google sign-in. You are responsible for keeping your credentials confidential. One account per person; sharing accounts is not permitted. A scan is counted each time you submit an image for AI identification, regardless of the result — including when the image is a card back, not a card, or a card from a game we don't yet support. As a courtesy, the first such mis-scan is automatically refunded; after that, mis-scans count toward your cap. Typing a card name for a plain price lookup does not consume a scan.
4. Subscriptions and billing
- Paid plans (Pro, Unlimited) are billed monthly in advance via Stripe. Stripe is the merchant of record for card processing.
- Prices are listed in USD and may include applicable taxes depending on jurisdiction.
- Subscriptions auto-renew at the end of each billing period until cancelled.
- Cancellations take effect at the end of the current billing period. You keep access until then. No partial refunds for the unused remainder of a cancelled period.
- Upgrades take effect immediately and are prorated.
- Downgrades take effect at the next renewal.
- If a renewal payment fails, the account is marked past-due and downgraded to the free tier until payment succeeds.
5. Refunds
All sales are final. We do not offer refunds for partial months, unused scans, scans consumed by user error (e.g. scanning a card back, a non-card, or an unsupported game — beyond the one-time courtesy refund described in Accounts), or accidental subscriptions. Charge disputes filed without contacting support first may result in account termination. Statutory refund rights (e.g., EU 14-day right of withdrawal for digital services) are honoured where they apply.
6. Acceptable use
You agree not to:
- Reverse engineer, scrape, or proxy the Service to resell it.
- Exceed your tier's daily quota by rotating IPs, creating multiple accounts, or other circumvention.
- Submit content that infringes others' rights or violates law.
- Disrupt the Service, attempt to access other users' data, or test security without permission.
- Use the Service for high-stakes decisions (insurance, lending, professional grading certifications) — it's an estimate tool.
We may suspend or terminate accounts that violate these rules without refund.
7. Third-party data
Prices, sales history, and product images are sourced from third parties. Their accuracy is not guaranteed. The Service includes affiliate links to retailers; clicking and purchasing through them may earn us commission at no cost to you. AI grading projections are experimental estimates — they are not equivalent to a professional grade from PSA, BGS, CGC, or any grading service.
8. Intellectual property
The Service's code, design, and content are owned by us or our licensors. Card names, artwork, and trademarks belong to their respective owners (Pokemon Company, Bandai, Wizards of the Coast, etc.) — PeekaScan is unaffiliated.
9. Disclaimers
The Service is provided "as is" and "as available." We don't warrant that prices are current, that the AI correctly identifies every card, that the Service is uninterrupted, or that it's free of defects. Use it at your own risk.
10. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to the Service is limited to the greater of (a) $100 USD or (b) the amount you paid us for the Service in the 12 months preceding the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data.
11. Termination
You can cancel anytime via the Customer Portal or by emailing us. We may terminate or suspend accounts for violations of these Terms, prolonged inactivity (12+ months on a free account), or if we discontinue the Service. Material discontinuation announcements will be emailed to active subscribers at least 30 days in advance, with a prorated refund of the unused subscription period.
12. Changes to these Terms
We may update these Terms. Material changes are reflected here with a new "Last updated" date and emailed to subscribers. Continued use after a change constitutes acceptance.
13. Governing law
These Terms are governed by the laws of British Columbia, Canada, without regard to conflict-of-laws principles. Disputes will be resolved in the courts located in Vancouver, BC, except where mandatory consumer protection law in your country provides otherwise.
